¿Qué es una declaración de obra nueva?
Cuando una edificación se acaba de construir, es indispensable que pase a formar parte de un registro. De esta manera, se añadirá al catálogo de viviendas que son susceptibles de compra.
Si bien la situación anterior es la más conocida, este proceso también puede ser necesario en otras circunstancias. Entre ellas, destacamos todas las que están relacionadas con las construcciones o remodelaciones de gran calibre.
¿Tiene la declaración de obra nueva impuestos asociados? Esta pregunta es muy común y la respuesta es que sí. Es obligatorio abonar los Actos Jurídicos Documentados, que en este caso se sitúan entre el 0´5 % y el 1´5 % del coste de la obra.
¿Cuál es el papel del notario en una declaración de obra nueva?

Declaración de obra nueva terminada
En este primer caso, se corrobora que el proyecto de construcción ha finalizado. Es fundamental para comprar o alquilar la propiedad, así como para realizar contratos de electricidad, agua y demás.
Para hacer una escritura de obra nueva, el notario le pedirá la siguiente documentación:
- Licencia de primera ocupación: Se obtiene en el ayuntamiento.
- Libro del edificio: Lo redacta el director de la obra y se consigue a través del promotor.
- Certificado de eficiencia energética: Para tenerlo, es necesario pasar una inspección con un técnico.
- Certificado final de obra: Lo elaboran el arquitecto y el arquitecto técnico.
- Seguro decenal: Cubre los daños por defecto que tenga una edificación durante sus diez primeros años.
- Certificado de coordenadas georreferenciadas: Se consigue tras presentar la ubicación en el catastro.
Declaración de obra nueva en construcción
Se utiliza para demostrar que se está llevando a cabo una edificación en la localización proporcionada. Solo es obligatorio si el banco lo exige para conceder una hipoteca.
Con este fin, necesitará disponer de los siguientes documentos:
- Certificado de dirección facultativa: Lo firma el director del proyecto y garantiza la adecuación de la obra a los requisitos.
- Licencia de obra: Se obtiene en el ayuntamiento.
Declaración de obra nueva antigua
La declaración de obra nueva antigua se utiliza para registrar una construcción que se emprendió hace varios años, pero que no se registró en su momento. También puede tratarse de edificaciones que están fuera de ordenación.
- Certificado de antigüedad y superficies: Lo firma un aparejador o un arquitecto.
- Coordenadas georreferenciadas.
- Certificado de inexistencia de infracción urbanística: Lo expide el ayuntamiento.
