What is the service or act of Oath of Nationality before a Notary?
The Oath of Nationality before a Notary is the final procedure that a foreign person must carry out to obtain and properly process Spanish nationality.
The Oath of nationality in Barcelona before a Notary is a very simple and easy act in which the interested party swears or promises before the Notary of their choice to be loyal to the King, obey the Spanish constitution, and respect the other laws of the Spanish legal system.
In cases where there is no dual nationality agreement with Spain, the interested party must also renounce their original nationality in order to acquire Spanish nationality. Despite this renunciation, it will be the legislation of the country of origin that ultimately determines whether the official documents of that country are effectively withdrawn. The countries whose citizens can obtain dual nationality are the Ibero-American countries whose languages are Spanish or Portuguese, as well as Andorra, the Philippines, Equatorial Guinea, or Portugal.
After these steps, the oath will be submitted to the Civil Registry and the birth certificate will be obtained, which will allow obtaining the Spanish DNI and Passport.
What is the role of the Notary for the Oath of Nationality?
The Notary is a legal professional with extensive training and considerable experience. Among their functions is to advise and counsel impartially and free of charge.
Applying complete impartiality, the Notary's mission is to inform all parties involved equally, providing greater assistance to the party that needs it most. Whatever the notarial procedure or act being considered, it is advisable that the interested party, if any doubts arise, does not hesitate to make the necessary enquiries, both on the day of signing and in the days prior.
It is important to know that for the nationality oath before a Notary, one must appear before a Notary competent in the domicile of the applicant as stated in the grant resolution. If the domicile has changed, the competent Notary will be the one of the last domicile, provided the change was made before the date of the Spanish nationality resolution. It is important to prove this fact with the certificate of registration.
What is said in the nationality oath?
The oath-taking ceremony within the notary's office is resolved in a simple and formal act where the foreign citizen answers yes or no to questions about loyalty to the King and obedience to the Constitution.

How is the oath of Spanish nationality made before a Notary?
The first step will be to obtain the Spanish nationality concession. For this, the following requirements are requested:
- Periods of legal residence: In general, 10 years of continuous residence are established as the residence period. This can be reduced to 5 years in the case of refugees, to 2 years with countries that have a dual nationality agreement, or to one year if the applicant:
- was born on Spanish territory
- did not exercise by option their right to acquire nationality
- has been under the guardianship, custody or foster care of a Spanish citizen or institution for two consecutive years
- has been married to a Spanish man or woman for one year
- is a widower or widow of a Spanish person
- or was born outside Spain as the child of a Spanish father or mother
- Good civic conduct
- Sufficient degree of integration. For this, and since 2015, it is accredited by passing two tests: the first certifies knowledge of the Spanish language at level A2 or higher (DELE exam) and the second assesses knowledge of the Spanish Constitution, and the social and cultural reality of the country (CCSE exam)
- Having no criminal record
- Valid documentation
Once the certificate has been obtained and after choosing the notary office for the oath of Spanish nationality, an appointment will be requested within the legally established deadlines. It will be essential to prepare all the necessary documentation for the correct processing.
Documents for the oath of Spanish nationality before a Notary
In accordance with current legislation, the documentation to be submitted to a notary for nationality oath is as follows:
- Resolution granting Spanish Nationality containing the personal data of the applicant and the CSV to verify the authenticity of the grant. From the moment the grant resolution is received, there are 180 days to process the nationality oath before a Notary.
- Original birth certificate with apostille: you must obtain your original birth certificate from the Civil Registry of your country, which must be apostilled in the country of origin.
- Certificate of no criminal record with apostille.
- Valid residence card.
- Updated padrón (municipal register) dated less than 90 days: you can obtain it at your Town Hall or authorised offices. Check if the data is correct via Cl@ve on the National Statistics Institute portal.
- Declaration of data form. This is an official document that allows registration in the Civil Registry and can be obtained on the Ministry of Justice website. It can also be provided by the notary’s office. This document is known as Annex 1, which we can supply from the notary’s office.
- If you have only one paternal surname, since it is necessary in Spain that one of the surnames is the mother’s maiden name of the person taking the nationality oath, documents proving which surname this is are required. Usually, the mother’s birth certificate or the parents’ marriage certificate duly apostilled and/or translated, if applicable, are presented.
All documents presented at the Oath must be the same documents previously submitted when processing the file.
Once the applicant has all the necessary documentation, they must attend the appointment with the Notary for nationality oath on the scheduled day and swear or promise Spanish Nationality.
After this step, only the corresponding deed needs to be sent to the civil registry. Do not hesitate to contact us to resolve any doubts or to request your appointment at JLA Notarios.
More questions related to the oath before a Notary
How much does the nationality oath before a Notary cost?
The price of the nationality oath is established in the Tariff (RD 1426/1989, of 17 November, which regulates the Notaries' Tariff). The price may increase depending on the number of documents included, or the translation of documents. The processing of the deed is included and we take responsibility for sending the Oath to the Civil Registry and receiving the certificate.
It is complicated to calculate the cost of a notarial document without knowing the exact content, as it may vary depending on the number of copies, pages or additions. For this reason, we recommend contacting us to receive a detailed quote. There are different channels to do so, such as the contact form on our website, in the contact section, using WhatsApp, by email at bcn@jlanotarios.com or by calling the telephone number 93 159 17 62.
However, and as a guideline for those wondering how much a Notary charges for the nationality oath, we can inform you that, according to the current regulatory legislation, the usual price for formalising a NATIONALITY OATH before a Notary is from 180 to 350 euros €, including VAT.
This indicative price is calculated for a document of 14 pages and with the issuance of a single copy: one original copy (intended for the Civil Registry) and another authentic copy (for the interested party).
In the case of the cost of a Spanish nationality oath before a Notary for minors, the price ranges from 180 to 350 euros, which may increase in relation to the attached documents and the increase in necessary pages.
What is the difference between a promise and an oath of nationality?
There is no difference between promise and oath in legal terms. Simply, the oath has a religious connotation that the promise does not have.
What is civil residence? How to choose civil residence in a Spanish nationality oath?
When we take an oath of Spanish nationality, we must choose a civil residence to be assigned to a territory. This means that the person is subject to either the general common civil legislation or the regional legislation (in these cases we find Catalonia, Aragon, Balearic Islands, Basque Country, Navarra, Galicia, and the civil residences of the Baylio jurisdiction of Extremadura).
The one related to the applicant must be chosen: by place of residence (proven with the registration certificate), place of birth (proven with the submitted birth certificate), residence of parents or adoptive parents (proven with the nationality and residence certificate of the parents), or residence of the spouse (proven by the marriage certificate). Practically, the civil residence of the place of residence will always be acquired.
Can I change my name in the nationality oath?
As a general rule, the name is retained, although in exceptions, it must be changed when it is not accepted in Spain. This could happen, for example, when the name is offensive. Thus, in the birth registration, the name appearing on the foreign certificate will be recorded, unless the use of a different name habitually used is proven. In the case of languages with different writing systems, such as Chinese, Arabic or Japanese, they will be recorded through transcription or transliteration. That is, achieving a graphic adaptation or phonetic equivalence. In names with Latin characters, orthographic adaptations will be made to facilitate their writing and phonetics.
The surnames in the oath before a Notary
In accordance with the regulations of the Civil Code, Civil Registry Law and the Instruction of the DGRN of 23 May 2007, it is established that every person must have two surnames, the first being the father's and the second the mother's. In the case of filiation through only one of the lines, the surnames will come from this line. If the person only has one surname, it must be duplicated.
In the case of EU citizens, it is possible to opt for a change of surnames or to keep those of their member state of origin.
At the time of the oath, the law allows choosing whether the first surname is the father's and the second the mother's, or this order can be altered so that the maternal surname comes first and then the paternal.
After the nationality oath ceremony
How long does it take to receive the birth certificate after the oath before a Notary in Barcelona?
After the signing of the nationality oath at the Notary, the Notary sends a copy of the oath to the Civil Registry. The Civil Registry will register the new Spaniard and must send an email to the person who has taken the oath and to the Notary with a document certifying the registration in this Registry (called a birth certificate). With this birth certificate, it is already possible to go to any National Police Station anywhere in Spain for the Police to issue the DNI and/or passport.
Currently, in Barcelona, the Civil Registry is quite overwhelmed and the time it takes to send the birth certificate to the people who have taken the nationality oath varies between 1 and 5 months. However, one is already fully Spanish from the signing of the oath at the notary, and the birth certificate is only necessary to obtain the DNI and/or passport.
In which Civil Registry must the Oath before a Notary be registered?
As a general rule, the oath of nationality is registered in the Civil Registry of the Province where the new Spaniard is registered. However, if the person taking the oath was born in Spain, the oath will be registered in the Civil Registry of the place of birth.
What happens after the oath of nationality before a Notary?
After the swearing before a Notary, as we have mentioned to you, the registration is processed at the Civil Registry, which must issue the birth certificate as a Spanish citizen. This certificate will be sent to you in PDF format with a secure verification code to the email address provided in the deed.
Afterwards, you can make an appointment at the National Police station anywhere in Spain to obtain your Spanish DNI and passport. Remember that you must bring the following documents:
- Birth certificate issued by the Civil Registry, printed
- Two ID photographs (32x26 cm)
- Certificate of registration from the Town Hall where you reside (valid for less than three months)
- Foreigner Identification Card or Certificate of Registration as a Union Citizen if necessary
What is the certificate of concordance?
This is a document that you must request from the police to prove that your NIE and DNI belong to the same person. With it, you will be able to change your details with the Tax Agency, Social Security, employment contract, banking institutions, medical centres, and the Directorate-General for Traffic.
How is an oath made before a Notary with minors?
Minors under 14 years old will not be able to swear nationality before a Notary as it is considered a highly personal act. This does not mean that they cannot obtain nationality by residence, but that the application will be handled differently. Thus, the parents must sign the public deed of acceptance of the nationality granted to the minor, along with the name and surnames with which they should be registered in the Civil Registry and the corresponding civil residence option.
In the case of minors over 14 years old, they must appear before a Notary together with their parents at the act of granting the deed as it is considered a highly personal act that they can perform. They must swear allegiance to the King, the Constitution and the laws, choose civil residence, renounce (or not) their nationality and state their name and surnames.
