- JLA Notarios: sale and purchase of property and asbestos certificate in Barcelona
The Law 8/2026, of 2 July, on the eradication of asbestos introduces, as of 3 October 2026, the asbestos certificate as a new information requirement in the sale and letting of properties situated in Catalonia.
The new regulation affects anyone who is going to sell, buy or rent a home, a commercial unit or other property in Barcelona or in any municipality of Catalonia.
However, some important issues are still pending regulatory development, especially the final characteristics of the certificate and the determination of who can issue it.
Therefore, in this article we distinguish between what is established by Law 8/2026, the provisional and indicative criterion communicated by the Colegio Notarial de Cataluña and the practical recommendations that can be followed while the regulation is approved.
Law 8/2026 comes into force, in general, on 3 October 2026. Part of its practical application remains pending regulatory development.
Asbestos certificate in Catalonia: the essentials
Are you going to sell or rent a property in Catalonia?
| Scenario | Duty to deliver and documentary action | Registration scope |
|---|---|---|
| Sale of property in Catalonia; negative certificate | Delivery to the buyer; record the date, issuer, property and scope of the conclusion and attach the document where appropriate. | The seventh additional provision refers to certificates of presence, not of absence. |
| Sale of property; positive certificate | Delivery and record that the buyer is aware of the state of conservation and the risk described in the document. | Provide for the registration record of the certification of presence and, where applicable, the assistance under article 26. |
| Lease | Delivery to the tenant in accordance with article 21.2; leave appropriate documentary evidence of the delivery. | The special rule of the seventh additional provision is linked to the registration of an onerous transfer of ownership. |
| Exchange or other onerous transfer transaction | The extension of the duty to deliver beyond sale and lease requires interpretation; as a precaution, request the certificate before executing. | If the transfer of ownership is registered and there is a positive certificate, consider the seventh additional provision. |
| Lack of certificate in a sale | Warn of the unfulfilled legal duty and of the risks; the preventive option is to obtain it before authorising. | Do not automatically assert either the nullity of the transaction or a mandatory registration closure without an express basis or applicable registry criterion. |
When there is a certificate of the presence of asbestos, the seventh additional provision provides for its entry in the register upon registration of an onerous transfer of ownership.
IMPORTANT: a negative certificate does not necessarily equate to stating that the property is 'free of asbestos'. Until the implementing regulations are approved, the Law requires at minimum proving the absence of visible asbestos at the time of its issue.
What is the asbestos certificate and what must it contain?
The certificate of presence or absence of asbestos is the specific document that reports on the presence or absence of asbestos in a property at the time it is issued.
Until implementing regulations are established, the Law sets out a minimum content relating to the presence or absence of visible asbestos.
Certificate of absence of asbestos: does it mean that the property is free of asbestos?
Not exactly.
The certificate attests, under the terms currently in force, to the absence of visible asbestos at the time of issue.
Therefore, it is more accurate to use this expression than to generally state that a dwelling or property is 'free of asbestos'.
Certificate of asbestos presence
When materials containing visible asbestos are detected, the certificate must indicate, as a minimum:
- their condition; and
- the risk they may pose to people.
When is the asbestos certificate compulsory in Catalonia?
Law 8/2026 comes into force generally on 3 October 2026.
From that date, Article 21 expressly requires the delivery of the certificate when a property situated in Catalonia is sold or let.
Asbestos certificate to sell a flat or property
In a sale, the seller must hand over the certificate to the buyer.
This obligation must be taken into account when preparing the sale of a dwelling, house, commercial premises or other property located in Barcelona or elsewhere in Catalonia.

When is it advisable to apply for it?
It is advisable to obtain the certificate before arranging the signing of the deed, so that it can be checked during the preparation of the sale and to avoid last-minute documentary issues.
Asbestos certificate for renting a dwelling or premises
Furthermore, the obligation is not limited to sales.
Article 21 also requires the provision of the certificate when a property is let; it must be given to the tenant.
Exchanges and other onerous transfers
At this point there is an important legal nuance.
Article 21 expressly refers to the sale and rental, whereas the seventh additional provision uses, when regulating the effects on the register, the broader concept of «onerous transfer of ownership».
They are not identical expressions.
Prudential criterion until a regulation is in place.
The provisional position of the Colegio Notarial de Cataluña advocates a broad interpretation. As a precaution, it is advisable also to prepare the certificate for an exchange or other onerous transaction transferring ownership, without presenting this interpretation as a literal equivalence established by article 21.
Which properties need an asbestos certificate?
The Law uses the general concept of property and does not limit the obligation exclusively to dwellings.
To which properties does the asbestos certificate apply?
The requirement for the certificate regarding the presence of asbestos applies to properties built before 2002. This date constitutes a fundamental reference point, since, from 2002 onwards, the commercialisation and use of materials containing asbestos was prohibited in Spain.
The prohibition derives from the Order of 7 December 2001, by which Real Decreto 1406/1989 was amended, relating to the restrictions on the commercialisation and use of certain dangerous substances and preparations.
For this reason, in sales of dwellings and other properties built before 2002 in Catalonia, special attention must be paid to the possible existence of materials containing asbestos and to compliance with the information and certification obligations established by the current regulations.
Flats, houses, commercial premises, warehouses and parking spaces
The obligation may affect different types of properties located in Catalonia.
The Law does not establish, in Article 21, a general exclusion on the grounds that it is a premises, an industrial unit, a parking space or another type of property.
Can it also affect a plot of land?
A plot should not be automatically ruled out simply because it is undeveloped.
A plot may contain remains of former buildings, installations or materials that contain asbestos.
Does that mean that a plot of land has asbestos?
No. The possible presence of these materials is a technical and factual matter that must be determined by the competent professional. It cannot be presumed by the notary.
Who can issue the asbestos certificate in Catalonia?
This is one of the issues still to be specified.
The Law expressly refers to the forthcoming regulation both the characteristics of the certificate and the determination of which authority is competent to issue it.
Can it be issued by an architect, an architectural technician or an engineer?
Until implementing regulations are in place, the provisional position of the Colegio Notarial de Cataluña considers profiles such as architects, architectural technicians and engineers to be technically adequate.
A pending regulatory matter
It should not be understood that the Law has definitively and exclusively conferred this competence on any of those professions.
It will be the future regulation that determines the characteristics of the certificate and the competence necessary for its issuance.
What happens if the certificate detects asbestos in the property?
The presence of asbestos does not automatically prevent the sale of the property.
When materials containing asbestos are detected, the certificate must report on their condition and the risk they may pose to people.
Can a flat with asbestos be sold?
Law 8/2026 does not treat the mere presence of asbestos as an automatic prohibition on selling the property.
What should the buyer know?
The buyer must receive the certificate and be aware of the information it contains.
The deed may record its delivery and properly identify the document.
The assessment of the existence, condition or risk of asbestos is a technical matter. It is not for the notary to carry it out or to replace the judgement of the competent professional.

Asbestos and the Land Registry: what is registered?
Additional provision 7 establishes a specific requirement for the certification of the presence of asbestos-containing materials when a transfer of ownership for consideration is registered.
Positive certificate: presence of asbestos
When the certificate determines the presence of asbestos, the registration record provided for by law must be taken into account.
Also, when they exist, any aid or subsidies obtained in accordance with Article 26 may be relevant.
Negative certificate: is the absence of visible asbestos also recorded in the Land Registry?
Additional provision 7 refers specifically to the certification of the presence of asbestos.
Therefore, it should not be asserted that the Law provides for identical publicity in the register for a certificate that determines the absence of visible asbestos.
What happens if the seller does not provide the asbestos certificate?
The Law establishes a duty to deliver the certificate, but it does not expressly declare that a sale concluded without it is void.
Nor does it contain an explicit general prohibition addressed to the notary from authorising the deed in their absence.
Can a sale be signed without a certificate?
The law does not expressly establish the certificate as a requirement for the validity of the sale.
However, this does not mean that the certificate is optional. There is a legal duty to deliver it, and its absence prevents the buyer from having the information that the new regulation seeks to guarantee.
Prudential criterion for the signature
The provisional guidance communicated by the Colegio Notarial de Cataluña considers that the most prudent course is to require its submission.
Therefore, it is advisable to obtain the certificate before attending the notary and to avoid its absence causing issues or delays in the preparation of the deed.
Is there a fine for not providing the asbestos certificate?
The Law classifies failure to comply with the duty to deliver as a minor offence and provides for fines of €100 to €3,000 for minor offences.
However, there is an important transitional regime.
Does this fine apply from 3 October 2026?
It should not be stated like that.
Sanctions regime pending development
The entry into force of the chapter containing this specific sanctioning regime is postponed until the approval of the corresponding implementing decree.
Therefore, the obligation to deliver the certificate comes into force generally on 3 October 2026, but the specific sanctioning regime has a separate date of entry into force.
Asbestos certificate to buy or sell a property in Barcelona
Law 8/2026 applies throughout Catalonia. Therefore, anyone intending to buy or sell a flat, house, commercial premises or other property in Barcelona must include this new documentation in the preparation of the transaction where appropriate.
What is advisable to send to the notary before a sale in Barcelona?
Together with the remaining documentation required to prepare the deed, it is advisable to provide the certificate in advance to verify:
- that it corresponds to the property being transferred;
- the date and the identity of the person issuing it;
- whether it declares the presence or absence of visible asbestos;
- the condition and the risk, when asbestos is present; and
- any possible grants or subsidies with implications for registration.

Why send it before signing?
Advance review allows potential issues to be identified and the deed to be properly prepared, preventing a documentary issue from arising for the first time on the day of execution.

Yes. Article 21 expressly mentions both sale and rental.
The definitive competence is pending regulatory development. The collegiate criterion provisionally mentions technically suitable profiles such as architects, technical architects and engineers.
The presence of asbestos does not by itself mean that the property cannot be sold. The certificate must report its presence, condition and the risk to people.
The obligation to inform the buyer and the obligations relating to the management or removal of asbestos are different matters. The existence of a positive certificate should not be interpreted as an automatic prohibition on selling until the material has been removed.
Law 8/2026 does not establish in article 21 an official price for the issuance of the certificate.
As at the date of this article's update, the Law does not establish a general limitation period in article 21. Future regulatory developments will also need to be taken into account.
No. The certificate refers to the condition of the property at the time it was issued and, until implementing regulations exist, the Law requires, at a minimum, evidence of the absence of visible asbestos.
