¿Qué es el acta de incomparecencia?
El acta de incomparecencia es un documento notarial otorgado ante un Notario en el que se acredita que una persona que debía acudir a una notaría no lo ha hecho cuando debía. También recibe el nombre de acta de ausencia o acta de inasistencia.
Determinados asuntos jurídicos requieren de la presencia en una notaría, como por ejemplo, firmar una escritura pública o tomar una acción tras un requerimiento notarial. Es frecuente que a un deudor se le requiera su presencia por un acuerdo privado de moratoria de pagos.
No obstante, este tipo de actas también son comunes en compraventas. Ocurren cuando una de las partes es citada en la notaría para otorgar la escritura de compraventa, pero no se presenta. En estos casos, la parte que sí ha acudido, ya sea el comprador o el vendedor, puede solicitar que se levante un acta notarial para acreditar la incomparecencia de la otra parte. Este documento sirve, principalmente, para justificar la retención de las arras. Es decir:
- Si el vendedor no comparece, el comprador puede quedarse con las arras entregadas.
- Si el comprador es quien no acude, el vendedor tiene derecho a reclamar el doble de las arras como compensación.
¿Qué consecuencias tiene el acta de incomparecencia?
Las repercusiones del acta de incomparecencia pueden ser variadas según la situación, pero lo que siempre busca constatar el acta de incomparecencia es la no presencia de una persona en un momento determinado en la notaría. De esta falta de presencia, se podrán derivar los efectos jurídicos que correspondan según cada caso concreto.
El papel del Notario en el acta de incomparecencia
El papel del Notario es fundamental en este acta de inasistencia ya que redacta el escrito, detallando que una de las partes citadas no se presentó y declara la fecha y la hora indicada para ello. De esta forma, se deja constancia de la ausencia y se emite el acta.
Las actas de incomparecencia se firman por el requirente del acta y el Notario autorizará el documento público.
En cuanto a la función del Notario, en este documento no da fe de que alguien no ha comparecido ni actúa como testigo civil en el acta, simplemente otorga el acta de incomparecencia, pretendida por la otra parte requirente, de la falta de presencia en ese momento dado.
Este acta notarial evita problemas para los requirentes, ya que pueden acreditar notarialmente su cumplimiento y el incumplimiento de la otra parte, lo que puede tener trascendencia jurídica.
Documentos necesarios para el acta de incomparecencia
Ante una incomparecencia notarial será necesario aportar:
- Documento identificativo en vigor de la persona que vaya a firmar el acta y, en su caso, de la sociedad que representa. Si es una sociedad, deberá aportar los documentos de la sociedad y del administrador.
- Identificación de la persona que no comparece y expresión de la razón por la que tenía que comparecer.
¿Cuánto cuesta un acta de incomparecencia?
El precio base de este trámite está regulado por el Gobierno y viene estipulado por el Arancel Notarial (RD 1426/1989, de 17 de noviembre, por el que se regula el Arancel de los Notarios). Es importante tener en cuenta que determinados aspectos como el número de folios, las copias autorizadas y simples que se emitan, diligencias y posibles consultas en el Registro Mercantil harán variar el coste final de este acto notarial.

¿Cuál es la diferencia entre un acta de comparecencia o acta de fe de vida con el acta de incomparecencia?
El acta de comparecencia acredita que una persona ha comparecido ante Notario en un día y hora determinado, mientras que la fe de vida acredita que una persona está viva en un momento determinado. Sin embargo, el acta de incomparecencia nos indica que no se ha presentado, sin saber motivo alguno.
