What is a nota simple?

A simple note is a document that contains different data about a house or other property and which most citizens consider more comprehensive than the one provided in the deed of a house.

More technically, an informative simple note is the document issued by the Land Registry in which the description of a property is outlined and its legal status is indicated. Thus, the most interesting aspect of an informative simple note is that it allows one to know the legal situation of a property and, especially, who the owners are and whether the property has any encumbrances or is free of charges.

It is mainly used when we want to buy a house or when it is necessary to know that a property is free of charges and does not bear any encumbrances or legal problems.

Simple note of a dwelling

The simple note of a property contains information such as:

  • Description of the property: the cadastral reference, location, type of property, square metres, location and associated plots.
  • Owners: the owners or who holds it in usufruct or bare ownership are listed.
  • Charges and encumbrances: As we mentioned earlier, if the property has attachments, pending auctions, arrears, whether in the IBI or related to the mortgage, encumbrances, etc., this information appears in the simple note of the property. Furthermore, they will appear even if they have already been paid.
  • Pending entries for dispatch and entries of the daily register submitted: in this case, it refers to pending registrations on the property due to the submission of documentation, such as preventive annotations of attachment or pending removal of the mortgage charge.

Request a simple note at the property registry

The simple informative note of a property can be requested from the Land Registry by anyone, as the Land Registry is a public registry. The applicant for the note must pay the cost of its issuance to the Registry.

Even so, the most common thing is that the request for a simple note is made when we are holders or representatives of the holder, have rights in inheritances over said property, are administrators, or are also applicants for information due to wishing to purchase it.

In this last case, it occurs before signing the deposit contract. You can learn more here:

At what times can the simple note be requested or can be requested from me?

Now that you know what a simple note is, we want to inform you of the occasions when you may need to request it.

Generally, in a sale, the seller is the one who provides this document. On other occasions, and after signing, the bank also usually requires it when making mortgage deeds. It is even one of the documents required by the notary on the day of signing the public deed of sale.

Furthermore, if you want to verify that all procedures have been carried out correctly, it is advisable to request a simple note once the purchase process is completed to ensure that the ownership of the property is registered in your name.

Where to request the simple note from the Property Registry?

You can request it at the Property Registry or through the website of the Colegio de Registradores de la Propiedad y Mercantiles.

However, from the notary's office, we will request the continuous simple note when carrying out notarial actions. This is a note with special characteristics, which we can only request from notary offices and which is more secure than the informative simple note that individuals can obtain.

Other inquiries related to the simple note

The timeframe is set between 24 and 48 hours. If you are in a great hurry, go directly to the Registry.

The Land Registry may take up to 15 days to reflect certain changes in the simple note, such as when lifting the mortgage charge on the property.

Yes, especially and exclusively, notaries can request the continuous simple note, a type of simple note that is more secure than others.

The continued simple note is a note from the Property Registry that can only be requested from the notary's office and which provides greater legal certainty in notarial transactions involving transfers of property ownership.

The main advantage of the continued simple note is that it is not purely informative (like the simple note) but that the Property Registry is responsible for the accuracy of the legal status of the property as described in the note. Therefore, the Property Registry is accountable for the statement it makes in a continued note of a property as being free of encumbrances or that the encumbrances listed in the note are accurate and that there are no others.

Furthermore, for 10 days from the request of this continued note by the Notary, the Registrar is obliged to inform of any changes that occur in the Registry affecting the property for which the continued note has been issued.
