Notarial Invitation Letter to Spain

Through the notarial invitation letter in Spain, a person invites another to spend a period legally in our country, assuming their expenses, obligations, and guaranteeing their return to their country. This type of notarial deeds occur in matters of immigration, and as Notaries in Barcelona, we explain everything about how to process them below.

Invitation letters are also known as statements of declarations, invitation records or records of financial responsibility.

The Invitation Letter to Spain

The invitation letter to Spain is a legal tool to be able to receive a foreign family member or friend in our country. Through the control it exercises, it prevents illegal trafficking and clandestine immigration, which is punished by the Penal Code in its article 318 bis and the introduction for profit of immigration according to Organic Law 4/2000, of 11 January. These actions are punished with fines ranging from 6,000 to 60,000 euros and with expulsion from the country or prohibition of entry for up to 10 years.

The invitation letter meets the requirements of the Schengen visa to stay in the country for family reasons, tourism or business. Not having it may cause entry to the country to be denied by the immigration authorities.

It can be requested by the visitor’s host before the National Police, and failing that before a Notary. In this latter way, for those who want to exercise their right to obtain a notarial invitation letter to Spain, they will find benefits of speed and agility in the process, without being subject to administrative delays.

This document is used in immigration controls to prove that the guest has a place to stay upon arrival in the country. However, it will only be valid while the visit lasts and, therefore, one must be created for each trip made.

Among the characteristics of invitation letters to foreigners is that they facilitate travel for those countries that have stricter entry controls and speed up the visa process (although they do not guarantee it).

How to bring a family member to Spain for a visit?

If you live in Spain, you will have often thought about how you would like a family member to visit you and see how you have built a new life. Perhaps you want your parents to come and visit you for a while, a brother to spend a holiday, or a close friend to get to know the culture and environment in which you now live.

Notarial invitation letters to Spain become the most useful legal tool to be able to receive them in the country, as the inviter declares their commitment and responsibility for the visitor in matters such as accommodation, maintenance, and repatriation. With this gesture, the immigration authorities exercise control over both the inviter and the invitee and prevent illegal immigration processes.

Who can request an invitation letter for foreigners?

It may be requested by:

  • Spanish citizens
  • Citizens of a European Union country or countries to which the Community regime applies, residing in Spain
  • Non-EU foreigners (outside the EU, EEA or Switzerland) who have legal residence in Spain

Who needs the invitation letter?

The free movement of people and residence within the EU means that this letter is not necessary for all countries. However, a letter of invitation for non-EU foreigners is required, which will be essential for those countries where a visa is not needed. For those where a visa is required, it will serve as an accelerator for the visa application of their citizens.
