El acta de acreditación de la propiedad de un vehículo es un documento notarial que se suele utilizar para regular la propiedad de un vehículo cuando se adquirió hace tiempo y no se inscribió adecuadamente su adquisición. También se conoce como acta de propiedad de vehículo o acta de matriculación de vehículo.

¿Qué significa acreditar la propiedad de un vehículo?
Este acta permite acreditar por notoriedad que la propiedad de un vehículo le pertenece y así conseguir que, como propietario del vehículo, conste como tal en la Administración de Tráfico (DGT).
Se trata de un documento bastante utilizado en diferentes situaciones. Una de ellas ya comentábamos que era cuando se produjo una inadecuada inscripción de su adquisición o no se formalizó adecuadamente la compra de un vehículo.
La DGT nos solicita que se presente un documento notarial que acredite la propiedad. Partiendo de la base que la mayoría de veces el acta para acreditar la propiedad de vehículo se elabora por falta de inscripción de la propiedad, este documento da fe que el vehículo cuya situación hay que regular es propiedad del firmante del acta.
Acta de manifestaciones para coches
El acta de acreditación de la propiedad de un vehículo es un tipo de acta de manifestaciones que permite que vehículos con pérdida de identificación o sin contrato escrito de compraventa pueda regularizarse. Se trata de un documento notarial que puede ser utilizado para regularizar la propiedad de un vehículo en Tráfico.
¿Cómo acreditar la propiedad de un vehículo?: El Acta de acreditación de la propiedad de un vehículo ante Notario
El primer paso será contactar con una oficina notarial, así que pida cita al Notario.
El día señalado debe presentarse junto con dos testigos que puedan justificar y confirmar que el vehículo es de su propiedad. Si tiene algún tipo de documento privado en que conste la propiedad también debe presentarlo en la notaría.
El papel del Notario para acreditar la propiedad de un vehículo
El Notario es una figura de Derecho imparcial que en la redacción del acta de acreditación de la propiedad de un vehículo extiende el documento de acreditación de la propiedad de vehículo donde se declara el propietario y es identificado. La figura del Notario dota de fe pública al documento, con lo que se obtendrá acreditación de la propiedad del vehículo.
No obstante, el Notario no da fe de la veracidad, pues simplemente, su función es recoger el contenido, eso sí, acreditando que las declaraciones han sido realizadas por la persona que se manifiesta en una fecha concreta.
El papel del Notario para el acta de manifestaciones no termina aquí, sino que también debe advertir de las posibles consecuencias jurídicas, legales y económicas de lo manifestado. Esto sucede, por ejemplo, en el caso de falsificar o mentir en la declaración.
Documentos necesarios
Entre la documentación que se considera requisito para acreditar la propiedad de vehículo encontramos:
- Identificación documental del propietario del vehículo, que será la persona que tenga que firmar el acta (DNI, NIE o Pasaporte en vigor) y de los testigos.
- Identificación del vehículo cuya situación hay que regularizar aportando el permiso de circulación del vehículo.
- Documentos que puedan acreditar la propiedad del vehículo como el contrato de compraventa que indique la transferencia de vehículo, pagos de impuestos asociados como el de circulación, seguros, revisiones ITV.
¿Qué sucede una vez que he obtenido el acta?
Con el acta como documento de prueba de la propiedad, ya es posible dirigirse a la Dirección General de Tráfico para que se adecúe el registro de propiedad del vehículo.
¿Cuánto cuesta la acreditación de la propiedad de un vehículo?
El precio base de este trámite está establecido por el Gobierno y regulado por el Arancel Notarial (Real Decreto 1426/1989, de 17 de noviembre). Es importante considerar que factores como el número de folios, las copias autorizadas y simples emitidas, las diligencias realizadas y las posibles consultas al Registro Mercantil pueden influir en el coste final del acto notarial.

De manera orientativa, según la normativa vigente, el precio habitual para formalizar un acta de acreditación de la propiedad de un vehículo cuesta habitualmente entre 110 y 160 €, IVA incluido. Este importe se calcula para un documento con contenido estándar e incluye la expedición de una copia autorizada y una copia simple.
