The certificate of ownership of a vehicle is a notarial document that is usually used to regulate the ownership of a vehicle when it was acquired some time ago and its acquisition was not properly registered. It is also known as a vehicle ownership certificate or vehicle registration certificate.

What does it mean to prove ownership of a vehicle?

This certificate allows to prove by notoriety that the ownership of a vehicle belongs to you and thus ensure that, as the owner of the vehicle, you are registered as such in the Traffic Administration (DGT).

It is a document widely used in different situations. One of them, as we have already mentioned, is when there was an improper registration of its acquisition or the purchase of a vehicle was not properly formalised.

The DGT requires us to present a notarial document that proves ownership. Based on the fact that most of the time the certificate to prove vehicle ownership is drawn up due to lack of registration of ownership, this document certifies that the vehicle whose situation needs to be regularised is the property of the signatory of the certificate.

The certificate of ownership of a vehicle is a type of statement certificate that allows vehicles with lost identification or without a written sales contract to be regularised. It is a notarial document that can be used to regularise the ownership of a vehicle with the Traffic Department.

How to prove ownership of a vehicle?: The Certificate of proof of ownership of a vehicle before a Notary

The first step will be to contact a notary office, so please make an appointment with the Notary.

On the appointed day, you must attend along with two witnesses who can justify and confirm that the vehicle is your property. If you have any type of private document proving ownership, you should also present it at the notary's office.

The role of the Notary in proving vehicle ownership

The Notary is an impartial legal figure who, in the drafting of the certificate of vehicle ownership, issues the document certifying vehicle ownership where the owner is declared and identified. The figure of the Notary endows the document with public faith, thereby obtaining certification of vehicle ownership.

However, the Notary does not attest to the truthfulness, as their function is simply to record the content, that is, certifying that the statements have been made by the person presenting themselves on a specific date.

The role of the Notary for the statement certificate does not end here, but they must also warn of the possible legal, judicial, and economic consequences of the statements made. This occurs, for example, in the case of falsifying or lying in the declaration.

Necessary documents

Among the documentation considered necessary to prove vehicle ownership are:

  • Documentary identification of the vehicle owner, who will be the person required to sign the report (valid DNI, NIE or Passport) and of the witnesses.
  • Identification of the vehicle whose situation needs to be regularised by providing the vehicle registration certificate.
  • Documents that can prove vehicle ownership such as the sales contract indicating the vehicle transfer, payments of associated taxes such as road tax, insurance, MOT inspections.

What happens once I have obtained the certificate?

With the deed as proof of ownership, it is now possible to go to the Directorate General of Traffic to have the vehicle ownership register updated.

How much does vehicle ownership accreditation cost?

The base price for this procedure is established by the Government and regulated by the Notarial Fee Schedule (Royal Decree 1426/1989, of 17 November). It is important to consider that factors such as the number of pages, the authorised and simple copies issued, the diligences carried out, and possible consultations with the Commercial Registry may influence the final cost of the notarial act.
