Knowing how to register a property in the Land Registry is essential for those who need to officially prove ownership of a plot of land, house or rural property and avoid future legal, inheritance or registration problems.

Some properties are not registered because they were never registered in the land registry. Therefore, it is not unusual for people to come to our notary office with doubts about how to register a property in the Land Registry, especially when they wish to sell a property, accept an inheritance, apply for a mortgage or regularise old family properties.

In these cases, it is usually necessary to analyse the specific legal situation of the property and study which procedure allows its registration to be correctly regularised. As property notaries, specialised in Property Law, we hope to assist you with this article.

How to find out if a property is registered in the Land Registry?

Before starting any procedure, it is essential to check if the property is already registered in the Land Registry. Many people believe that a property is registered simply because they pay the IBI, it appears in the Cadastre, or they have old private deeds. However, the Cadastre and the Land Registry are different entities and a property can exist in the cadastre without having been registered in the Land Registry.

To check if a property is registered, it will usually be necessary to request a simple registry note or a registry certificate of the property from the Land Registry corresponding to the location of the property.

We explain what it is here:

In our case, our notary office is close to the Property Registry of Barcelona, at Paseo de la Zona Franca 109 (Torre Marina building). However, Registry notes are now obtained electronically.

Through this consultation you will be able to verify:

  • if the property is registered,
  • who appears as the registered owner,
  • the official description of the property,
  • the existing charges,
  • or if there are discrepancies between the Cadastre and the Registry.

The search will reveal:

How to interpret the result of the registry query?

How to register a property for the first time in the Land Registry?

To respond to the initial query about how to register a property in the Land Registry for the first time, we must specify that there are different legal routes to achieve the first registration of a property. However, one of the most common when it has never been registered before is to process a dominio file to register a property at a notary’s office. Inmatriculación is the name of the legal procedure for the first registration in the registry.

This procedure is appropriate when there are doubts about the available documentation or the registration status of the property. Thus, notarial intervention allows for a prior analysis of the feasibility of the registration and to check which legal route is most suitable to regularise the property.

Furthermore, notarial advice helps to review the existing documentation, coordinate the registration and cadastral status of the property, and avoid future problems related to the ownership of the property.

For this, it is necessary to draw up said notarial deed and send it to the Land Registry. After an analysis and certain official publications, if it is validated, the registration of the property is permitted. You can learn about this process step by step in our notarial service:

Is it possible to sell a property without registering it?

Legally, it is possible to sell a property that is not registered in the Land Registry. However, in practice, the lack of registration usually causes significant difficulties and risks for both the seller and the buyer.

Currently, many real estate transactions require the property to be properly registered in order to formalise:

  • mortgages,
  • bank financing,
  • inheritance transfers,
  • subdivisions,
  • or future sales with legal certainty.

Furthermore, when a property is not registered, the buyer may have difficulties officially proving ownership, subsequently registering the property, or checking for possible encumbrances and disputes over the property.

For this reason, before selling an unregistered property, it is advisable to regularise its registration status beforehand. Once achieved, it will be possible to process the relevant deed of sale.

Frequently asked questions about the property registration certification in Barcelona

Each property belongs to the Land Registry corresponding to the geographical location of the property. For this reason, before requesting registry documentation or starting any procedure, it is important to correctly identify which Land Registry has jurisdiction over the property.

This information can be obtained through:

  • the exact address of the property,
  • the cadastral reference,
  • old deeds,
  • or previous registry enquiries.

The registry certification of a property is an official document issued by the Property Registry that legally certifies the registry status of a property.

It can be consulted for:

  • the registered owner,
  • the official description of the property,
  • existing charges,
  • limitations,
  • or the rights registered over the property.

Unlike the simple note, the registry certification has official evidential value before third parties and may be necessary in certain judicial, notarial, or registry procedures.
